1.1 The Website – www.frenchrevolution.ro (“ Website ”) is the property of French Revolution SRL , a legal entity under Romanian law, with registered office in Bucharest, Romania, Str. Constantin Ghercu No. 1B, Bridge Building 3, Ground Floor, Sector 6, registered with the Trade Register Office under no. J40/4987/2013, Unique Registration Code 31511366, referred to throughout these Terms and Conditions, “ French Revolution ”.

1.2 Marketing of Products through the Website – The Products (“ Products ”) offered are those listed in the catalog published on the Website, within the limits of available stocks. The Products that French Revolution offers to its Customers are made to high quality standards. French Revolution specializes in the production and sale of a certain type of cake – the Eclair (“ Eclair ”). French Revolution uses authentic French recipes in the manufacturing process of the Eclairs sold. French Revolution sells the Eclairs made both through the Website and in its stores in the country. ( See locations on the map )

– The catalog published on the Website includes the following Products: Eclair; Box of mini eclairs; Coffee package; Gift Cards; T-shirts, Reusable cups, Agenda, Pencil, Pins.

1.3 The Website User is:

• Natural person, at least 18 years old, with full legal capacity;
• Any representative of a legal entity registered and operating in accordance with the laws of Romania, acting in the name and on behalf of the legal entity;
• Any authorized natural person (PFA) who accesses, orders or purchases Products through the Website, referred to throughout these Terms and Conditions as " Customer ".

1.4 Scope of the Terms and Conditions – The Terms and Conditions define the conditions of use of the Website and the contractual conditions governing the relationship between French Revolution and the Client. By accepting the Terms and Conditions, the Client agrees that:

• If the Client is a natural person, he acts in his own name and does not represent any other person, and if he is the representative of a legal entity, he acts within the limits of the power of attorney granted to him;
• The Customer will provide correct and complete information for the use of the Website;
• The Customer shall not use the Website to reproduce, duplicate, copy, sell, resell, distribute, publish or exploit, for any commercial purpose, the software, content, offerings, products or services provided by French Revolution, or obtained through the Website without obtaining the express, prior and written consent of French Revolution. This restriction includes any attempt to incorporate any information from the Website into any other catalog, product or service;
• The Customer will not use the Website in any way that could adversely affect the availability of its resources or its use by other Customers or in any way that could damage, disable, overburden or impair the servers or networks of French Revolution or third parties;
• The Customer will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions or other relevant policies.

1.5 Acceptance of Terms and Conditions – By accessing and using the Website, the Client acknowledges and accepts these Terms and Conditions, as well as other policies relevant to the Website. In order to use the Website in good conditions, the Client is obliged to carefully read and comply with the Terms and Conditions, as well as any other relevant policies of the Website, as they are displayed on the Website or will be notified to the Client at a certain time.

1.6 Modification of Terms and Conditions – French Revolution reserves the right to unilaterally modify the Terms and Conditions, as well as any other relevant policies, at any time. Continued use of the Website in any way, including by ordering and purchasing Products, after the modification of the Terms and Conditions represents the Customer’s acceptance of the modifications made. The modified Terms and Conditions will be applied to any order/transaction starting from the day of their modification. The Terms and Conditions were last updated on: 23.01.2023.

1.7 Website Accessibility – The Website is accessible to customers 24 hours a day, 7 days a week except in cases where maintenance operations are carried out. French Revolution reserves the right to unilaterally interrupt access to the Website (in whole or in part), at any time, with immediate notification to users, by message displayed on the Website at the time of access. French Revolution cannot be held liable to the Customer and/or third parties for the lack of functionality or for the non-compliant operation of the Website.

2.1 Creation of an Account by the Customer

To make purchases through the Website, the Customer has the option to purchase Products without having an account on the Website, or may choose to create such an account, in order to facilitate future orders on the Website. If the Customer chooses to create an account, this will be done by following the instructions in the "Create an account" section.

The Customer is responsible for maintaining the confidentiality of the data associated with his account created on the Website.

The data requested by French Revolution at the time of creating an account by the Client is necessary for the management of orders and commercial relations between French Revolution and the Client.

The password will not be used for making online payments, it will only be used for the purpose of registering the Customer and creating an Account in order to place online orders.

Customers are required to provide true, accurate and complete data as indicated in the registration form and to renew, whenever necessary, the registration data to be true, accurate and complete at all times.

In the event that the Client provides information that is not true, inaccurate or incomplete, French Revolution reserves the right to suspend or terminate the account and to refuse all current or future attempts to use the Website services, without any compensation to the Client.

These conditions must also be met in the case of registering the Clients' participation in the Contests/Promotions organized and presented on the Website by French Revolution, Contests/Promotions that will be governed by distinct regulations.

The Customer is entirely responsible for maintaining the security and confidentiality of the account and password and is responsible for all activities and conduct of the Customer or any other person who places orders for Products through the account.

The Customer agrees to notify French Revolution immediately of any suspected unauthorized use of its account and of any suspicion of a possible breach of security. French Revolution or its representatives will not be liable for any loss or damage of any kind that may arise as a result of the use, by another person, of the account, with or without the Customer's permission. The Customer is liable for any losses caused to French Revolution or any third party as a result of the use of the Account by another person.

In the event of the Client’s failure to comply with the Terms and Conditions or any other relevant policies, French Revolution reserves the right to deactivate the Client’s account, without any compensation and without giving prior notice or any other formality, after notifying the Client by email. In the event of fraud or violation of any applicable laws by the Client, the account will be deactivated without prior notice, without notice, without other formalities and without compensation, French Revolution proceeding exclusively to inform the Client by email.

If you lose or forget your password, it can be regenerated by accessing the " My Account " box and entering your email address, after which a password will be sent to you by email. The password is strictly confidential.

The customer who wishes to deactivate his account can do so by following the instructions on the Website, in the " My Account " section or by writing to us at contact@frenchrevolution.ro. The account cannot be deactivated between the time an order is placed and the delivery of that order.

In the event that a Customer wishes to place an order on the Website without registering by creating an account, they will be able to do so by entering the data requested by the Website at the time of placing the order.

2.2 French Revolution products offered for sale

Each type of Product offered for sale on the Website is accompanied by a description of it, allowing the Customer to become aware of essential information regarding its characteristics before completing an order.

The images used to describe the Products on the Website do not represent a contractual obligation on the part of French Revolution, they are used exclusively for presentation purposes.

The information displayed on the Website is for informational purposes only and is not intended to replace the advice of specialists in various fields (e.g. nutrition).

2.3 Availability of Products and validity of offers

Product offers and prices displayed on the Website are valid as long as they are visible on the Website and within the limit of available stock.

Valid products and offers will be signaled on the Website by the presence of the " Add to Cart " button next to them.

2.4 Product Prices

The prices of the Products presented on the Website are expressed in LEI and include all taxes, except for shipping costs.

The applicable prices are those displayed on the Website at the time of validation of the order by the Customer. In the event that the Products in the shopping cart undergo price changes, the new prices will be signaled to the Customer before the order is completed. The prices include VAT, and all legal changes regarding the amount of this tax will be reflected in the price of the Products present on the Website at the time of entry into force of the respective regulatory act.

2.5 Placing the Order and concluding the sales contract

Placing orders through the Website can only be done for addresses in Bucharest.

In order to place and register an order, the Customer must follow the instructions displayed on the Website in this regard. Before validating the order, the Customer will be provided with a summary of the information related to the order: the number of items ordered, the date, the French Revolution store from which the products were requested to be picked up or the delivery address (in the case of orders with delivery), the chosen time slot, as well as the total payment. The order is validated by a “click” on the “ ONLINE PAYMENT ” button. By validating the order, the Customer accepts that this order implies an obligation to pay and agrees to accept these Terms and Conditions.

Orders not validated by accessing the " PAY ONLINE " button and completing the payment will not be honored. The simple fact of adding Products to the shopping cart does not constitute validation of the order and does not create any obligation for French Revolution to proceed with the provision of the Products to the Customer.

French Revolution confirms the registration of the order through an automatic e-mail sent to the Customer, through which the following information will be communicated to him/her: the list of ordered items, the prices of the Products, the French Revolution store from which the Customer requested to pick up the order or the delivery address (in the case of orders with delivery), the chosen time slot, as well as the invoice for the ordered Products.

In this case, the sales contract will be considered to be concluded on the date of receipt by the Customer of the confirmation of the order registration.

French Revolution may request additional information about the order, including, but not limited to, the address and time at which the order is to be delivered, if the information initially provided by the Customer is not sufficient to fulfill the order. In this case, the order will be validated and the sales contract will be considered concluded only on the date of receipt of the new requested information. In the event that the Customer fails to provide the additional requested information, the sales contract will not be considered validly concluded, and French Revolution will not be obliged to fulfill the order.

The minimum value of the order with delivery placed through the Website is 250 (two hundred fifty) lei. For the avoidance of doubt, each order placed with delivery must be a minimum of 250 (two hundred fifty) lei.

For orders placed through the Website, shipping is free.

For orders placed through the Website for which the Customer opts to pick them up in person from the indicated French Revolution stores, there is no minimum order value. ( See locations on the map )

The conditions for placing orders are as follows:

Orders are placed at least one day in advance.

The customer will not be able to place orders for busy periods, but not limited to religious or legal holidays, days with special significance, for example: March 1, March 8, June 1, etc.

For reservations of Products, the Customer may contact French Revolution at the telephone number 0755 222 800, at the e-mail address comenzi@frenchrevolution.ro or in the chat section of the Website. In this case, the order will be considered completed when French Revolution sends the order confirmation.

The Customer has the opportunity to track the status of their orders placed on the Website, as well as the history of transactions made by accessing the " My Account " section.

2.6 Payment for Products

Payment for orders can be made in the following ways:

• Online payment by bank card.

All banking transactions on the Website will be carried out in a secure manner, the payment processor being the guarantor of this security in terms of making online payments and is obliged to protect all personal data and information related to online payment methods, and to retain them, only if necessary.

The payment amount for the validated order will be blocked from the valid card registered by the Customer at the time of validation of the respective order.

The amount actually paid for the order will be withdrawn when the transaction is processed by the responsible financial-banking institution and cannot be greater than the amount initially blocked at the time of order validation.

The customer guarantees to French Revolution that the use of the chosen payment method does not violate any applicable law. French Revolution reserves the right to suspend/cancel any order for which there are suspicions of any illegal or fraudulent action regarding the payment method.

French Revolution reserves the right to suspend/cancel all orders in the event of refusal to make payment by financial and banking institutions (if the Customer has chosen to pay for the Products online), without any compensation or notification to the Customer.

All information entered to make an online payment (frame number, password, card validity date) will not be stored on French Revolution servers, but will be processed exclusively by the card-issuing banking units.

For orders placed on the Website, a Tax Invoice will be automatically issued, replacing the Tax Receipt. The tax invoice for an online order will be issued in electronic format and will be sent by e-mail. The Customer will be able to download and print the Tax Invoice attached to the e-mail.

If a Product ordered by the Customer cannot be delivered for reasons beyond the control of French Revolution, the Customer will be informed of this and the value of the product will be returned to his bank account, within a maximum of 14 days from the date on which French Revolution became aware of this fact.

2.7 Delivery and collection of Products

The client has the option to choose between the following methods:

• Delivery of the Products to the address indicated by the Customer at the time of placing the order;
• Picking up the Products from the French Revolution work point indicated by the Customer at the time of placing the order.

The Customer undertakes to be present at the receipt of the order at the address indicated in the order. If the Customer is not available to receive the order in person, he will designate another person in his place, provided that the designated person is at least 18 years old.

The customer is obliged to verify the accuracy of the information provided regarding the delivery address prior to validating the order (street, street number, block/building, number, floor, intercom code, postal code). In the event of errors in entering this information, French Revolution will not be held responsible for the impossibility of delivering the order, delayed delivery of the order or for any other consequences.

The delivery of orders to the delivery address indicated by the Customer is ensured by French Revolution, with its own refrigerated trucks, through its representatives called " Couriers ".

Deliveries will take place between 10:00 and 20:00.

At the request of French Revolution or the Courier, the Customer will provide proof of his/her identity, if necessary, through one or more documents issued by official authorities and will communicate the order number assigned by the sales system.

If the Customer is unable to receive the order in person, the order will be delivered to the specified address only to a person at least 18 years old and only if the order number is communicated to the Courier.

No request for delivery of an order will be honored if the Customer does not meet the above conditions. In the case of delivery to a location selected by the Customer, if the Courier cannot access the respective location, the Customer must ensure that he can receive this order.

The Customer will be contacted by telephone by the Courier in advance to obtain confirmation of his presence at the address and time selected when validating the order on the Website.

The Customer or the person designated by him/her undertakes to be present at the indicated delivery address. Otherwise, the Customer will have the opportunity to pick up the Products from one of the French Revolution stores. If he/she does not pick up the Products, the Customer may request the return of the Products' value to a bank account or may contact French Revolution (0755 222 800) to set a new delivery date. The delivery is considered to be fulfilled by French Revolution at the time of handing over the ordered Products to the Customer, at the address selected by him/her.

The Customer or the designated person undertakes to check the condition of the delivered Products.

French Revolution is committed to responding to all requests and complaints within 5 business days of receiving them.

In the event that the delivery date and time slot selected by the Customer cannot be respected, the Customer will be immediately informed by all means made available by the Customer.

In case of delay in delivery of the ordered Products, French Revolution advises the Customer to notify us of this delay by contacting us at the telephone number 0755 222 800 in order to find the optimal solution for the delivery of the products.

2.8 Right of withdrawal

Upon receipt of the order, the Customer must ensure that the delivered Products meet his/her expectations in terms of quality and quantity. Otherwise, the Customer may notify French Revolution by calling 0755 222 800 or by e-mail at contact@frenchrevolution.ro, as soon as possible to remedy the situation.

According to the provisions of GEO no. 34/2014, the right of withdrawal does not apply to contracts for the supply of Products that are susceptible to deterioration or expire quickly. Therefore, the Customer does not have the right to withdraw from the Contract, respectively to return or refuse to receive an ordered Product.

2.9 Wrongly delivered products

If you have been delivered a different Product than the one you ordered or if you have been delivered a Product that you did not order, please report this as soon as possible by calling 0755 222 800 or by e-mail at contact@frenchrevolution.ro, in order to remedy the situation.

The shipping cost of the product and the costs related to the delivery of the ordered product (if applicable) will be borne by French Revolution.

The content of the Website is protected by applicable intellectual property laws, including but not limited to Law No. 8/1996 on copyright and related rights. All text, formatting (including, without limitation, the selection, coordination and arrangement of materials on the Website) and images, graphics, animations, instruments, applications, music, sounds, articles, copies, materials, photographs, trademarks, trade names and logos, as well as other materials and information on this Website are protected by intellectual property rights of French Revolution, its subsidiaries and affiliates, and their licensors (collectively, the “ Content ”). These materials may not be copied, reverse engineered, decompiled, disassembled, modified, published on other websites, framed, changed or distributed, redistributed, licensed, sub-licensed or transferred in any form by the Client. Nothing on the Website shall be deemed to grant, directly, implicitly, or otherwise, any license or right to use, for any purpose, the Content, in whole or in part. The trademarks, logos, trade names, and brands, both registered and unregistered (collectively, the “ Marks ”) displayed on the Website are Marks of French Revolution or its affiliated third party partners. Nothing on the Website should be construed as granting, directly, implicitly, or otherwise, any license or right to use any Mark displayed on the Website.

The Client declares and understands that any unauthorized use of these materials constitutes a violation of the intellectual property rights of French Revolution or its affiliated third party partners and will entail the exercise by them of all legal remedies.

French Revolution grants the Customer a limited, non-exclusive, revocable license to view, distribute, print or download any Content, as defined above, from the Website, for its own personal use. The Customer is not granted the right to license, republish, distribute, copy, assign, sub-license, transfer, sell, create derivative works or make any other non-personal use of any Content on the Website. No part of the Content may be reproduced in any form or incorporated into any electronic or mechanical information retrieval system, other than for the purpose of personal use. The Customer may not access or use the Website in any manner that could or is intended to harm or impair the Website or any server or network underlying the Website, or to interfere with the use and right of any other person or entity to use the Website.

The Website may contain links (" Links ") or references to other websites/webpages for the use of which specific Terms and Conditions of Use will apply, as specified on the respective websites/pages, French Revolution being not responsible and assuming no obligation for the content of the respective websites and/or with respect to any other links or references therein to other websites or web pages.

The inclusion of these Links or references on the Website is usually done for the assistance or in the interest of the Client, and in other cases for advertising purposes.

French Revolution does not guarantee/control the timeliness/accuracy of the information present on third-party websites to which Links from the Website are sent.

By continuing to use the Website, the Customer understands and accepts that they access those websites and/or use the products/services offered through them, exclusively at their own risk and responsibility and that French Revolution is not liable for any damages suffered as a result of accessing these Links and using the services made available on the websites to which the Links refer.

The Client declares and acknowledges that it agrees to indemnify, defend and hold harmless French Revolution and its contractual partners and their officers, directors, employees and affiliates from any and all liability, loss, claim and expense, including but not limited to reasonable attorneys' fees and costs, in connection with or resulting from: (i) the User's breach of these Terms and Conditions, or any other relevant policies, in particular those regarding confidentiality; (ii) the Client's improper use of the Website; (iii) the Client's failure to comply with or infringement of copyright or other intellectual property rights or other rights of third parties by violating the clause - Intellectual Property - of these Terms and Conditions.

French Revolution will compensate the Customer for direct damage caused as a result of: (i) the breach of these Terms and Conditions, (ii) culpable acts committed with intent or gross negligence by its employees. In these two cases, the remedies provided for in these Terms and Conditions will apply first.

All force majeure events defined by Romanian legislation represent a reason for suspension and termination of French Revolution's obligations.

Neither party shall be liable for failure to perform its obligations under these Terms and Conditions if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is any external, unforeseeable, absolutely invincible and unavoidable event.

If, within 15 (fifteen) days from the date of its occurrence, the respective event does not cease, each party will have the right to notify the other party of the cancellation of the order, without either party being able to claim any other damages from the other.

French Revolution cannot be held liable in these cases of force majeure.

These Terms and Conditions are subject to Romanian law. In the event of disputes, the Customer may submit complaints to the e-mail address contact@frenchrevolution.ro in order to reach an amicable settlement. However, in the event that an amicable agreement between the parties has not been reached, the disputes will be resolved by the competent courts.

By using the Website you expressly agree to the following provisions of these TERMS AND CONDITIONS:

– COMPLAINTS AND LITIGATIONS;

According to the requirements of Law No. 677/2001 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as amended and supplemented, of EU Regulation No. 679/2016 (General Data Protection Regulation) and of Law 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, French Revolution SRL is obliged to manage the personal data you provide to us securely and only for the purposes specified below.

Your consent to the use of personal data by French Revolution SRL may be revoked at any time, the revocation having effects only for the future.

The recorded information is intended for use by French Revolution SRL and is communicated only in order to fulfill the legal/fiscal/contractual obligations incumbent on the Company.

The personal data communicated will not be disclosed to third parties for the purpose of sending them offers, advertising messages or advertisements.

Your data will not be transferred outside the territory of Romania.

The processing of the requested personal data is necessary for the purpose of registering orders and delivering orders, respectively issuing invoices in your name, and refusal to provide this data may make it impossible for us to register your order, deliver your products and issue your invoices.

In relation to the processing of personal data and under the conditions specified by Law No. 677/2001 and in the European Data Protection Regulation 679/2016, you may exercise any of the following rights:

• the right of access to personal data concerning you;
• the right to request rectification or updating when data is inaccurate or incomplete;
• the right to request the deletion of data in certain circumstances (for example: when personal data is no longer necessary for the purposes mentioned above);
• the right to request restriction of processing in certain circumstances;
• the right to file a complaint with us, the court and/or the competent data protection authority;
• the right to object to processing.
